Minnesota Workers’ Compensation Claims

Carrie O’Brien is deeply familiar with the Minnesota workers’ compensation system and the insurance companies that operate within it. She has worked with many of the same adjusters, defense attorneys, and medical experts who often appear in these cases — giving her clients a valuable strategic advantage.

Through years of experience, she has also developed relationships with trusted physicians and vocational professionals who help build strong, well-supported claims. Whether you’re just beginning your case or struggling with a denied claim, Carrie will help level the playing field and guide you step-by-step through your rights under Minnesota law.

Permanent Partial Disability (PPD)

Minnesota’s workers’ compensation system assigns a specific value to nearly every part of the body — a “Permanent Partial Disability” or PPD rating. The percentage of disability determines how much compensation an injured worker receives.

As a general guide:

– 1%–5% = approximately $750 per percentage point

– 6%–10% = approximately $800 per percentage point
– 11%–15% = approximately $850 per percentage point

Exact amounts can vary depending on your date of injury and other factors. Some areas of the body, such as the lower back, may even qualify for multiple rating categories.

Carrie O’Brien Law works directly with your doctor to ensure you receive the highest rating legally supported by your medical condition — helping to maximize your total benefits.

Minnesota Wage Loss Benefits

When a work injury prevents you from earning your usual income, you may be entitled to wage loss benefits under Minnesota workers’ compensation law. These benefits come in two main forms:

Temporary Total Disability (TTD)

If you’re completely unable to work because of your injury, you may receive two-thirds of your gross weekly wage — up to a statutory limit (typically 104 weeks of benefits).
For example, if you earned $300 per week before your injury, your TTD benefit would be approximately $200 per week.

Temporary Partial Disability (TPD)

If you can return to work but at reduced hours or pay, you may qualify for TPD benefits.
This is calculated as two-thirds of the difference between your old wage and your new post-injury wage.
For example: if you previously earned $300 weekly and now earn $200, your benefit would be two-thirds of the $100 difference, or about $66.66 per week.

These benefits are not taxable income and do not need to be reported on your tax return.

Job Rehabilitation

If your injury limits your ability to perform your job, you may qualify for rehabilitation services through a Qualified Rehabilitation Consultant (QRC).

Your QRC ensures:
– You’re working within your doctor’s restrictions.

– Your employer offers suitable light-duty or modified work.
– You’re supported if your employer cannot accommodate you.

If your employer is unable to provide appropriate work, your QRC can help with:

– Resume preparation

– Job search training
– Interview coaching
– Job leads and placement support

You may also be eligible for mileage reimbursement for your job search and medical appointments.

Medical Expenses

Under Minnesota law, the workers’ compensation insurer must pay for all reasonable and necessary medical treatment related to your work injury.

This includes:

– Doctor visits and chiropractic care
– X-rays, MRIs, and physical therapy
– Prescription medication
– Mileage reimbursement for travel to and from treatment

There are no co-pays or deductibles — your medical costs should be fully covered when treatment is approved as work-related.
